As attorneys and lawmakers, we have largely deferred to non-lawyers the job of determining standards for compliance with certain laws. That has many consequences, and one of them is that those non-legal types are usually ill-equipped to understand the concept of subjective legal standards. It's their nature to look for the checklist and then demand absolute fealty to it.
